TESTIMONIAL RELEASE FOR CHENIECE PATRICK OBM
I hereby and irrevocably consent to the use, reproduction, editing, publication, distribution, broadcasting, displaying, recording, posting, copyrighting, licensing, digitization, and/or re-release of my testimonial by Cheniece Patrick OBM, operating under the laws of the state of Mississippi and the USA, as well as its employees, designees, directors, officers agents, independent contractors, affiliates, associates, legal representatives, successors, agents and assigns, for marketing, advertizing, fund raising, or any other lawful purpose, through any form of media, including but not limited to social media, promotional materials, printed publications, commercial products, education, course materials, video footage, websites, broadcasts, or any other medium.
I understand that my name, title, website URL, image, photograph, audio recording, video recording, and other identifying factors may be revealed to the general public in connection with the testimonial. I understand however that my location, physical address, email address, phone number or any other contact details will be kept confidential and will not be divulged to the general public.
I claim no ownership of the testimonial. I forego any opportunity, whether past or present, to copyright or trademark the testimonial, and I waive any right to royalties or other compensation arising from or related to the use of the testimonial.
I hereby release Cheniece Patrick OBM (including its employees, designees, directors, officers agents, independent contractors, affiliates, associates, legal representatives, successors, agents and assigns) from any and all claims and demands which may arise from or relate to any use of the testimonial, including, but not limited to, claims for privacy violations, right of publicity claims, libelous material, defamation and/or any other intellectual property rights.
I indemnify and hold Cheniece Patrick OBM harmless (including its employees, designees, directors, officers agents, independent contractors, affiliates, associates, legal representatives, successors, agents and assigns) from and against any and all legal claims and demands, including reasonable attorney’s fees, court costs and other legal expenses, which may arise from or relate to the testimonial.
This Testimonial Release constitutes the entire understanding between the parties and specifically incorporates, supersedes and replaces all prior or contemporaneous oral and written representations, understandings or agreement. No portion or provision of this Testimonial Release may be changed, modified, amended, waived, supplemented, discharged, canceled or terminated orally or by any course of dealing, or in any manner other than upon written notice.
If any part or provision of this Testimonial Release is found to be ineffective or invalid, it shall not invalidate or render unenforceable the remainder of this Testimonial Release which shall continue in full force and shall be enforced to the maximum extent possible.
This Testimonial Release shall be governed by and construed in accordance with the laws of the state of Mississippi and the USA.
I represent and warrant that I have the power and authority to authorize this Testimonial Release and that the testimonial will not violate the intellectual property rights of any third party.
I certify that I am over eighteen (18) years of age and have full legal rights and authority to consent to the terms of this Testimonial Release.
